Using Mercer. The terms.

These terms govern your use of mercertheme.com (this marketing and documentation site) and the Mercer theme for Shopify, both provided by ZBANG LTD (“we”, “us”). By using the site or installing the theme, you agree to these terms. If you do not agree, don’t use them.

The theme and your license

Mercer is licensed, not sold. What you may and may not do with the theme is set out in the theme license, which forms part of these terms.

Purchase and payment

Mercer has not been submitted to or approved by Shopify and is not available for purchase or installation. We plan to distribute it exclusively through the Shopify Theme Store, subject to Shopify’s approval. This site does not sell or distribute theme packages outside the Theme Store. If Mercer is listed, purchases, trials, payments, and installs will be handled by Shopify, and Shopify’s Theme Store terms will apply. We do not store your payment details.

Refunds

Shopify Theme Store purchases are final sale and non-refundable, subject to Shopify’s limited store-transfer exception and any statutory rights that cannot be excluded. Mercer does not offer a separate money-back guarantee. See the refund policy page.

Support

Standard support covers Mercer bug fixes and questions about its settings and documented features. It is not limited to the first 30 days after purchase. Custom development, third-party app work, and migration of custom code are not included. Reach us through the support form; we reply to support requests within two business days. The support policy explains what is and is not included.

Theme updates

Published Mercer updates will be available free through Shopify when released. This does not promise particular future features, a release schedule, or perpetual development. Review and test an updated draft before publishing, especially if your store uses custom code or apps.

Acceptable use of this site

• Don’t abuse the support form (spam, automated submissions, or attempts to deliver malicious content).
• Don’t attempt to disrupt, probe, or gain unauthorized access to the site or its infrastructure.
• Don’t scrape or republish the documentation or theme code in a way that conflicts with the license.

Intellectual property

The Mercer theme, this site, the documentation, and the Mercer name and marks are owned by ZBANG LTD. Your license grants you the right to use the theme as described in the license — it does not transfer ownership.

Disclaimer

The site and the theme are provided “as is” and “as available,” without warranties of any kind except those that cannot be excluded by law. We don’t warrant that the site will be uninterrupted or error-free. For help with the theme’s documented behavior, see the support policy.

Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim relating to the theme or this site is limited to the amount you paid for your Mercer license. We are not liable for indirect, incidental, or consequential damages, including lost sales or data.

Changes to these terms

We may update these terms. When we do, we update the date at the top of this page; that stamp is the authoritative version. Continued use after a change means you accept the updated terms.

Governing law

These terms are intended to be governed by the laws of England and Wales, without regard to conflict-of-law rules. Nothing here removes consumer-protection rights you have under the law of your own country of residence.
