Using Mercer. The terms.
Last updated · 2026-06-02
These terms govern your use of mercertheme.com (this marketing and documentation site) and the Mercer Shopify theme, both provided by ZBANG LTD (“we”, “us”). By using the site or installing the theme, you agree to these terms. If you do not agree, don’t use them.
The theme and your license
Mercer is licensed, not sold. What you may and may not do with the theme is set out in the theme license, which forms part of these terms.
Purchase and payment
Mercer is distributed through the Shopify Theme Store once listed. This site does not sell or distribute theme packages outside the Theme Store. Purchases, trials, payments, and installs are handled by Shopify through the Theme Store listing, and Shopify’s own Theme Store terms apply to those transactions. We do not store your payment details.
Refunds
We back Mercer with a 30-day functional support policy. The full terms, and how to request a refund, are on the refund policy page.
Support
Support covers bug fixes and questions about the theme. Reach us through the support form; we aim to give a first response within two business days. The support policy explains what is and is not included.
Acceptable use of this site
- Don’t abuse the support form (spam, automated submissions, or attempts to deliver malicious content).
- Don’t attempt to disrupt, probe, or gain unauthorized access to the site or its infrastructure.
- Don’t scrape or republish the documentation or theme code in a way that conflicts with the license.
Intellectual property
The Mercer theme, this site, the documentation, and the Mercer name and marks are owned by ZBANG LTD. Your license grants you the right to use the theme as described in the license — it does not transfer ownership.
Disclaimer
The site and the theme are provided “as is” and “as available,” without warranties of any kind except those that cannot be excluded by law. We don’t warrant that the site will be uninterrupted or error-free. The theme’s documented behavior is the standard we hold ourselves to — see the refund policy.
Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim relating to the theme or this site is limited to the amount you paid for your Mercer license. We are not liable for indirect, incidental, or consequential damages, including lost sales or data.
Changes to these terms
We may update these terms. When we do, we update the date at the top of this page; that stamp is the authoritative version. Continued use after a change means you accept the updated terms.
Governing law
These terms are intended to be governed by the laws of England and Wales, without regard to conflict-of-law rules. Nothing here removes consumer-protection rights you have under the law of your own country of residence.
